John Suthers named his book about the job of a public prosecutor "No Higher Calling, No Greater Responsibility". He may probably be right. That brings into focus the people whose job it is to prosecute crimes. The responsibility and demands of the job requires utmost skill and professionalism in those who are charged with the job. John Bugliosi was an experienced prosecutor when he wrote "The Art of Prosecution". One way in which we can tell if it was a good book is to see if the tone of the book provides an immediate impact. practising one of the methods he preached, Bugliosi's writing style was clear, crisp and without hype. It was clinical, instructional, and inspiring.It was appropriate that he began by describing the tools that a prosecutor needs for the job, and he describes and explains the qualities needed to be a good prosecutor. He helps inexperience prosecutors in knowing what and how to prepare a case for trial, examples of court room techniques were carefully and aptly chosen. He has a chapter on the 'voir dire", a mini-trial within the trial to determine the admissibility of disputed evidence.I found his advice on the opening address and closing summation to be wonderfully written. These are the two aspects of a trial that a prosecutor (and defence lawyer) must grasp because everything else that happens in the trial, as Bugliosi explains, depend on how the prosecutor opens and closes his case. This book was written for the jury trial so in the bulk of cases in which the new prosecutor is likely to take to trial are likely to be before a professional and experienced judge sitting without jury. Some of the techniques recommended might not be appropriate without some adjustments. His advice to appeal to the juror's common sense, emotion, and morality, for example, may have to be toned down when a lawyer is addressing a judge less the submission becomes patronising and pedantic; which is a sure way of annoying the judge.
This is like a how to guide to prove a case. As a prosecutor, this book is a fantastic a resource for advice on case preparation/caseload management.But in my opinion, where it really shines is teaching trial advocacy for ASA's/ADA's. No longer do you need to scour Trial Ad books -filled with advice for defense attorneys and civil litigators - for a nugget of prosecutorial guidance. This book goes through jury selection to summation giving techniques and examples that are tremendously helpful if you're willing to put the time in. This is a book that you can study for hours at a time, and while it can be dry at times, it's well worth it. I've personally used some of Bugliosi's techniques in trial with great success. This is really the best around if you want to learn how to prove your case and beat the defense.
As a 3rd year assistant prosecutor who works in an office with next to no guidance, this book has become my manual. After using The Art of Prosecution to win my 1st jury trial, I purchased a copy for 3 other APs! It's the prosecutor's version of Thomas Mauet's Trial Advocacy.
